A new watchdog report is stirring fresh controversy around OpenAI — this time, over claims that its GPT-4o model was likely trained on copyrighted O’Reilly Media books without permission.
The Details:
The AI Disclosures Project, co-founded by O’Reilly Media’s CEO, says GPT-4o shows a high level of recognition of non-public O’Reilly book content.
Researchers used DE-COP, a technique that detects whether AI was trained on specific text, to probe GPT-4o and GPT-3.5 Turbo.
GPT-4o displayed greater familiarity with paywalled content vs. earlier models, suggesting it was likely trained on those books.
No formal licensing deal exists between O’Reilly Media and OpenAI, the paper says — and the authors rule out public access or user-pasted text as sole explanations.
While the results aren’t a “smoking gun,” they add pressure to OpenAI’s already mounting legal battles over training data.

If true, this raises serious questions about OpenAI’s respect for copyright boundaries — especially as it seeks to license its models to businesses and governments. As scrutiny around AI training practices grows, transparency and accountability may become just as important as performance.
